Home-Based Food Business Information

"I would like to operate a business from my home in Johnson County and the focus of my business will be food. What will I need to do to operate my business legally?"

This question is much more complicated than it would appear.  Several regulatory agencies could be involved in the process depending on the food products that are to be prepared, manufactured or distributed. 

Generally, businesses involving food activities must be conducted in an area that is designed, designated, and operated solely for that purpose. The equipment provided in that designated area will vary depending upon the food produced. This equipment may include:
 

  • a hand-washing sink
  • three compartment ware washing sink with 18" drain boards on each end
  • washable floors, walls, and ceilings
  • shielded lights
  • access to a mop sink

Additionally, home businesses served by Johnson County Wastewater may be required to install a grease interception device. JCED can provide further information on grease requirements.


Your first step is to determine the regulatory agencies that you need to contact before bringing your idea to reality. Once you know that, read further down for more details and contact information.
 

First, the Agencies

Johnson County Environmental Department (JCED)
Kansas Department of Agriculture (KDA)
Kansas Department of Health and Environment (KDHE)
 

The Food Categories

Bakery -- cakes, cookies, bread, pastries, etc
Responsible Agency --  KDA

Caterer -- box lunches, corporate lunches or dinners, wedding receptions, etc.
(Note: If someone goes to a grocery store and purchases a deli tray to deliver somewhere, they are not a caterer)
Responsible Agencies -- JCED and KDHE

Cooking Classes -- food/cooking instruction

Commissary -- provides an area for mobile food vendors (hot dog carts, taco trucks, lunch wagons, etc.) to go for daily cleaning of the truck and equipment and for re-stocking. Additionally, they may prepare foods at the commissary which are sold from the mobile vehicles.

Confectionary (Candy) -- Chocolates, mints, etc.
Responsible Agency --  KDA

Food Manufacturer -- barbeque sauce, salsa, cookie dough, dry ingredient mixtures, etc.

Food Distributor -- sells foods which may or may not be warehoused at the sales location
Responsible Agency --  KDA

Food Warehouse -- receives food items for storage and distribution
Responsible Agency --  KDA

Food Repacker -- receives food in bulk and breaks down into smaller packages for resale. This may include packaged foods which are left in their original packaging for gift baskets.

OK, What Do I Do Now?

If your home business falls under JCED and KDHE:
See New or Changed Establishment Ownership. Follow the steps outlined in Procedures for Obtaining a State of Kansas Food Service License, including the plan review.  Also, additional plan review information is here, along with application forms and a checklist to help the process go smoothly.  Even though these pages refer to opening a separate establishment, they are still appropriate for a home business.

JCED contracts with KDHE to conduct the Food Inspection Program in Johnson County.  State licenses are issued for food service establishments operating in Johnson County; there are no County food service licenses. 

If your home business falls under KDA:
These are State of Kansas administrated programs (plan review, licensing, and inspection activities). Contact KDA directly and their staff will assist you.

If your home business is located in Overland Park:
In addition to the agencies already identified, you will also need to contact the City of Overland Park.  Your business may be subject to licensing by both the State and the City of Overland Park.
