Licensing Procedures
For Obtaining
State of Kansas Food Service License
in New or Extensively Remodeled Facilities and Ownership Changes
| Under contract with the state of Kansas, Johnson County Environmental Department (JCED)
is responsible for licensing food service establishments in Johnson County, Kansas. This
process includes: reviewing pre-construction plans (in new and remodeled establishments),
processing changes of ownership, and verifying establishments meet minimum "Kansas
Food Code" requirements.

- Call JCED at 913-715-6900 if you have questions or to schedule an appointment for
the plan review.
- Approximately one week prior to plan review date, submit the following information
to JCED:
- Plans must include proposed location of:
- Food service equipment
- Refrigeration equipment
- Hand sinks
- Three compartment sink with drain boards on each end
- Mop sink
- Vegetable preparation sink
- Finish schedule (floors, walls, ceilings)
- Toilet facilities
- Storage facilities
- Plumbing
- Electrical
- Outside trash disposal
- Ventilation
- Other relevant items
- Grease Interceptor Review Form must be completed and returned to JCED for all
food service establishments in the Johnson County Unified Wastewater Districts (JCUWD).
Note: Areas not in JCUWD include portions of Olathe, DeSoto, Edgerton, Spring Hill, Gardner,
and Stilwell. However, you must check with these cities for their grease interceptor requirements.

- Upon completion of construction and prior to opening, JCED will conduct a pre-opening
inspection using "Kansas Food Code" K.A.R. 28-36-101 through K.A.R. 28-36-108 and
the "New Establishment Inspection Report."
If violations are found, the establishment may not be licensed or allowed to open until those
items are corrected. All equipment must be operating. When the final inspection is conducted,
it is expected that your facility will be in the condition that you could open and immediately
begin serving food to the public.
Examples: Refrigeration units are operating (41°F and below) and equipped with thermometers;
freezers are operating at 0°F and below (thermometers provided); a metal stem probe type
thermometer (0°-220°F range) for checking food temperatures and chemical test strips for
checking sanitizer concentrations must be in the facility; hand sinks are provided with soap
and paper towels; etc.
This inspection is for your Kansas Department of Health and Environment,
or Kansas Department of Agriculture, State Food Service
License only. Don't confuse this with other approvals you may need such as a municipal occupancy
permit, building occupancy permit or City Health License.
- The licensing application for the correct agency must be completed, signed, and given to the inspector along with
the fees. Applications for both KDHE and KDA can be found
here. The fee payment must be in the form of a check or money order made payable to:
Kansas Department of Health and Environment (KDHE), or Kansas Department
of Agriculture (KDA), in the amount of $400.00
($200 for the Application plus $200 for the License). Satellite Schools and Satellite
Senior Meal Sites pay $330.00 ($200 for the Application plus $130 for the License).
Note: Licenses are valid January 1 through December 31 for the year in which the
license was issued. Renewals are currently $200 annually. There are no provisions for the
pro-rating of licenses or refunding of license fees.
The inspector will submit the completed packet of pre-opening information (New Establishment
Inspection Report, Application, and Fees) to KDHE Bureau of Consumer Health in Topeka,
or Kansas Department of Agriculture, also in Topeka, who will
issue the State Food Service License.
