Pre-Variance/Rule Exception Protocol Requirements

If the platted lot is less than two acres, a variance/rule exception must be done. Below are the requirements that must be met. For further details refer to the Johnson County Environmental Sanitary Code (Chapter 2, Article 1, Sections 5 and 6).

The four listed requirements must be met and materials submitted to the Johnson County Environmental Department before a variance/rule exception can be processed. The seven (7) day processing period specified in the 1994 Environmental Sanitary Code does not start until all listed information has been provided, along with the completed application and fee.

  1. A legal survey must be completed, with the house/commercial building staked out.

  2. A soil profile must be completed.

  3. Blueprints of the house/commercial building must be made available.

  4. The septic system or holding tank design and layout must be done by a County approved contractor/designer.
