Any person who maintains or operates a construction/demolition landfill site or permits
the use of Property for such shall maintain and operate the site in conformance with
the following practices unless otherwise allowed by the department in issuing the
required permit.

| 1. |
Open burning shall be prohibited unless a variance or exemption is obtained
from Johnson County Environmental Department. Visit the Air Quality

| 2. |
Demolition wastes may not be deposited in surface or groundwaters. |
|
| 3. |
Dumping of the demolition wastes shall be confined to as small an area as
practicable and with appropriate facilities to confine windblown material
within the area. At the end of each day of operation, all windblown material
resulting from the operation shall be collected and returned to the area by
the operator. |

| 4. |
Demolition wastes shall be compacted as densely as practicable. When dumping methods
are used, the lifts should be limited to four feet of compacted wastes. |
|
| 5. |
When combustible materials are disposed, a compacted earth firebreak shall be
provided whenever a lift has progressed 50 feet in length or at the end of a
working week, whichever occurs first. Firebreaks shall be provided as earth
cover on top of deposited wastes on the working face and on side slopes if any. |

| 6. |
Surface water drainage shall be diverted around and away from the landfill
operating area. |
|
| 7. |
A minimum separating distance of 20 feet, or greater as specified by the
director, shall be maintained between the disposal operation and the
adjacent property line. |
|
| 8. |
Effective means shall be taken, if necessary, to control flies, rodents, and other
insects or vermin. |
|
| 9. |
Adequate dust control on the site shall be provided. |
|
| 10. |
Equipment adequate for operation of the site shall be provided and kept at the
site during hours of operation. |
|
| 11. |
Arrangements shall be made with the local fire control agency to immediately acquire
their services when needed. |
|
| 12. |
The Site shall be adequately screened by existing or provided means. |
|
| 13. |
Access to the site shall be controlled. A gate shall be at the entrance to the site
and kept locked when an attendant is not on duty. |
|
| 14. |
Site closure: |

|
a. |
Within one month after final termination of a site, including a termination of a
stage, phase, cell, or a major part thereof, the areas shall be covered with at
least two feet of compacted earth material, graded to a minimum 2% slope and 33%
side slopes to promote surface water runoff without excessive erosion. Bulky items
shall not protrude through top or side slopes. |

b. |
The finished surface of the filled area shall be covered and maintained with adequate
topsoil and seeded to provide suitable vegetation immediately upon completion of filling,
or immediately in the spring on areas terminated during winter conditions. If necessary,
seeded slopes shall be covered with straw or similar material to prevent erosion. |

|
c. |
Prior to completion of a demolition landfill site, the Department shall be notified in
order that a site investigation may be conducted by the Department staff before earthmoving
equipment is removed from the property. |
|
|
d. |
After completion of a demolition landfill site, a detailed description including a plat,
shall be filed with the county register of deeds. The description shall include general
types and location of the wastes, depth of fill and other information of interest to
future landowners. |
